Assault cases involving allegations of domestic violence or family violence
are as serious as any charge that can be brought against you in a
misdemeanor court. While a first conviction or probation or deferred
adjudication for a family violence case is a Class A misdemeanor with a
punishment range of up to one year in the county jail and/or a $4000 fine,
another arrest for the same charge is a
3rd degree felony, punishable by
up to
10 years in prison and/or a $10,000 fine. In addition, many Texas
courts will set an outrageously high bond ($50,000 or even $100,000) for a
person simply accused of assault (family violence) if that person has
previously plead guilty or been convicted of  domestic violence. That is why
having an experienced Texas assault lawyer like Don D. Becker on your
side to help you with your assault case is so important.

A wrongful accusation of family violence or spousal assault is something
that can stay with you for the rest of your life. Some employers will not
hire someone who has an assault conviction involving family violence on
their record. Allegations of assault (family violence) often are used against
you in divorce court.   And charges of assault (family violence) may also
result in a Texas court issuing a Magistrate's Order
of Emergency Protection, preventing you from talking with
or seeing members of your family,
even if you haven't done anything
wrong
(and even if the alleged victim insists that such an order is
not necessary and is not wanted).

In many, many cases, the alleged victim will say that he or she wants to
"drop the charges". This often happens because the accuser has simply
calmed down after the initial burst of anger that resulted to the making of
the false allegations. It can happen because the so-called victim feels
remorse after discovering the serious consequences of having made a false
allegation. And sometimes the allegedly injured party has simply sobered
up and realized for the first time that there has been an injustice.
Unfortunately, it isn't that easy. It is the State of Texas that has filed
charges against the accused. Only the district attorney prosecuting the case
can "drop the charges". And very few will do so unless you have made the
arrangements to have an aggressive, experienced attorney  like Don D.
Becker on your side to help you when you need it most.
